01 Acceptance of Terms

These Terms & Conditions ("Terms") constitute a legally binding agreement between you ("User", "you") and PerPayGold Pvt. Ltd. ("PerPayGold", "we", "us", "our") governing your access to and use of the PerPayGold mobile application, website, and all associated services (collectively, the "Platform").

By registering an account, accessing the Platform, or using any of our services, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must immediately stop using the Platform.

02 Eligibility

To use the PerPayGold Platform, you must meet the following eligibility requirements:

• You must be at least 18 years of age
• You must be a resident of India with a valid Indian bank account
• You must have a valid government-issued identity document (Aadhaar, PAN card)
• You must not be barred from using financial services under any applicable Indian law
• You must not have a previously terminated PerPayGold account due to a breach of these Terms

PerPayGold reserves the right to refuse registration or terminate access if eligibility criteria are not met or cannot be verified.

03 Account Registration & Security

To access PerPayGold services, you must create an account by providing accurate, complete, and current information. You are responsible for:

• Providing truthful information during registration and keeping it up to date
• Maintaining the confidentiality of your login credentials and PIN
• All activities that occur under your account, whether authorised by you or not
• Immediately notifying us at support@perpaygold.com if you suspect unauthorised access to your account
• Not sharing your account credentials with any third party

04 Gold Transactions

PerPayGold enables users to buy, sell, and hold digital gold. The following terms apply to all transactions:

Additional transaction terms:

• All transactions are final and non-reversible once confirmed
• Gold prices are dynamic and may change between the time of order placement and confirmation
• PerPayGold does not guarantee any specific gold price or return on investment
• Minimum transaction amounts may apply as displayed within the Platform
• Transaction limits may be imposed based on your KYC tier and regulatory requirements

05 Fees & Charges

By using PerPayGold, you agree to pay the applicable fees as disclosed on the Platform at the time of each transaction. These may include:

• Transaction Fee: A small percentage applied to each buy or sell transaction
• Storage Fee: Annual fee for holding gold beyond the free storage period (if applicable)
• Delivery Charges: Applicable when requesting physical delivery of gold
• GST: Goods and Services Tax as mandated by the Government of India
• Payment Gateway Fees: Charges levied by the payment processor (passed through at cost)

All applicable fees will be clearly disclosed before you confirm any transaction. PerPayGold reserves the right to modify its fee structure with prior notice of at least 7 days.

06 KYC & Regulatory Compliance

PerPayGold operates in compliance with the Prevention of Money Laundering Act (PMLA) 2002, RBI guidelines, SEBI regulations, and all other applicable Indian laws. As such:

• KYC verification is mandatory before you can conduct transactions above the prescribed threshold
• You must provide accurate and authentic identity documents — submission of false documents is a criminal offence
• PerPayGold reserves the right to suspend or close accounts that fail to complete KYC within the stipulated time
• Transaction monitoring is conducted to detect and prevent financial crimes, fraud, and money laundering
• We are legally obligated to report suspicious transactions to the Financial Intelligence Unit of India (FIU-IND)

07 Prohibited Activities

You agree that you will not use the PerPayGold Platform to:

• Violate any applicable local, national, or international law or regulation
• Use another person's account or impersonate any individual or entity
• Conduct fraudulent transactions or engage in market manipulation
• Attempt to reverse engineer, decompile, or tamper with the Platform or its underlying code
• Introduce malware, viruses, or any harmful code into the Platform
• Use automated bots, scripts, or scraping tools without our written consent
• Circumvent security measures, authentication systems, or transaction limits
• Use the Platform for any speculative or Ponzi scheme
• Engage in any activity that could damage, disrupt, or overburden our infrastructure

Violation of any of the above may result in immediate account suspension, legal action, and reporting to relevant authorities.

08 Intellectual Property

All content on the PerPayGold Platform — including but not limited to the logo, brand name, design, text, graphics, software, and user interface — is the exclusive property of PerPayGold Pvt. Ltd. and is protected under Indian and international intellectual property laws.

• You may not copy, reproduce, distribute, or create derivative works from any Platform content without our prior written consent
• You may not use the PerPayGold name, logo, or trademarks in any manner without explicit authorisation
• Any feedback, suggestions, or ideas you submit to us may be used by PerPayGold without any obligation to compensate you

09 Disclaimers

PerPayGold provides its services on an "as is" and "as available" basis. We make no warranties, express or implied, including:

• That the Platform will be uninterrupted, error-free, or free from viruses or other harmful components
• That gold prices will move in any particular direction or that you will earn any return
• That information on the Platform is always accurate, complete, or current
• That the Platform will meet your specific requirements or expectations

10 Limitation of Liability

To the maximum extent permitted by applicable law, PerPayGold shall not be liable for:

• Any indirect, incidental, special, or consequential loss or damage
• Loss of profits, revenue, data, or business opportunities
• Losses arising from unauthorised access to your account due to your own negligence
• Service interruptions caused by events beyond our reasonable control (force majeure), including but not limited to natural disasters, government actions, cyberattacks, or network failures
• Any loss resulting from your reliance on information provided on the Platform

In all cases, our maximum aggregate liability to you shall not exceed the total amount of fees paid by you to PerPayGold in the three months preceding the event giving rise to the claim.

11 Account Suspension & Termination

PerPayGold reserves the right to suspend, restrict, or permanently terminate your account at any time, with or without notice, if:

• You breach any provision of these Terms or our Privacy Policy
• You fail to complete KYC verification within the required timeframe
• We suspect fraudulent, illegal, or suspicious activity on your account
• We are required to do so by a court order, regulatory directive, or law enforcement request
• Your account has been inactive for more than 24 consecutive months

Upon termination, your access to the Platform will cease immediately. Any gold balance held in your account will remain accessible for redemption subject to applicable verification and legal hold requirements.

12 Refunds & Dispute Resolution

All confirmed gold transactions are final. However, in the case of a technical error or an unauthorised transaction, you may raise a dispute within 7 days of the transaction date.

• Raise a dispute via the in-app support section or by emailing support@perpaygold.com
• Our team will investigate and respond within 5 business days
• Refunds, if approved, will be credited to your original payment method within 7–10 business days
• Disputes not raised within 7 days of the transaction will not be entertained

13 Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in [City], India.

Before initiating any legal proceedings, the parties agree to attempt resolution through good-faith negotiation for a period of 30 days. If unresolved, disputes may be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996.

14 Amendments to Terms

PerPayGold reserves the right to revise these Terms at any time. When material changes are made, we will:

• Notify registered users via email at least 14 days before the changes take effect
• Display a prominent notice within the Platform
• Update the "Effective Date" at the top of this document

Your continued use of the Platform after the effective date of any revision constitutes your acceptance of the updated Terms. If you disagree with any changes, you must stop using the Platform and may request account closure before the changes take effect.
